1. GENERAL
1.1 Enterprising Enterprises Limited (“we”, “us”, “our”) reserves the right to amend these Terms & Conditions at any time without prior notice.
1.2 Continued use of this website or continued trading with us constitutes acceptance of the most current Terms & Conditions.
1.3 These Terms & Conditions are governed by the laws of New Zealand.
2. PRODUCT INFORMATION & REPRESENTATION
2.1 We make every effort to ensure product descriptions, specifications, and images are accurate at the time of listing.
2.2 As our products are natural food products, variations in colour, size, texture, aroma, or taste may occur between batches due to seasonal, agricultural, or processing factors. Such variations do not constitute a fault.
2.3 Product images are indicative only and may differ from bulk, foodservice, or trade formats.
3. PACKAGING, FORMAT & PRESERVATION METHODS
3.1 Packaging formats, materials, and packing methods may vary depending on pack size, logistics, and storage requirements.
3.2 Bulk or foodservice packs may use industry-standard methods such as foil pouches, vacuum sealing, or nitrogen flushing to preserve freshness and shelf life.
3.3 Nitrogen flushing uses food-grade inert nitrogen gas and does not alter product ingredients, origin, quality, or safety.
3.4 Differences in packaging or format between retail and bulk packs do not indicate differences in product specification or quality.
4. SHELF LIFE, BEST BEFORE DATES & FOOD SAFETY
4.1 All products are supplied within their stated best before dates at the time of dispatch unless otherwise disclosed.
4.2 A best before date relates to product quality, not food safety.
4.3 Foods past their best before date may still be legally sold and consumed provided they are safe to eat and are not labelled with a use by date.
4.4 This is in accordance with Food Standards Australia New Zealand (FSANZ) guidelines:

4.5 Shorter remaining best-before periods, particularly on bulk or discounted products, do not constitute a defect.
4.6 We do not sell products past their use by dates.
5. PRICING
5.1 Prices are subject to change without notice due to fluctuations in raw materials, freight, currency exchange, labour, or operating costs.
5.2 The price confirmed at checkout or invoicing is the final price for that transaction.
5.3 We do not retrospectively amend pricing once an order has been confirmed or dispatched.
5.4 Wholesale pricing is confidential and subject to separate approval and trading terms.
6. ORDERS & PAYMENT
6.1 Orders are confirmed only once payment is received, unless credit terms have been formally approved in writing.
6.2 Accepted payment methods may include PayPal, POLi, Stripe, direct deposit, or invoice payment gateways.
6.3 Transaction or merchant fees associated with card or third-party payments may be passed on to the customer where applicable.
6.4 Failure to complete payment may result in order cancellation.
7. CREDIT ACCOUNTS & OVERDUE PAYMENTS (B2B)
7.1 Approved credit terms must be strictly adhered to.
7.2 Overdue balances may accrue interest at the prevailing bank overdraft rate from the due date until paid in full.
7.3 We reserve the right to suspend supply, revert accounts to prepayment, withhold stock, or place accounts on hold where balances are overdue.
7.4 Unpaid balances may be referred to a debt recovery agency. All reasonable collection and legal costs may be passed on to the customer.
8. DELIVERY, TITLE & RISK
8.1 Risk in goods passes to the customer upon dispatch or collection.
8.2 Customers must inspect goods immediately upon delivery.
8.3 Claims for shortages, damage, or incorrect items must be reported within 48 hours of delivery with supporting photographs.
8.4 Claims made outside this timeframe may not be accepted.
9. RETURNS, REFUNDS & CHANGE OF MIND
9.1 Due to the nature of food products, we do not accept returns or offer refunds for change of mind.
9.2 Differences in taste preference, aroma, texture, packaging, or personal expectation do not constitute a fault.
9.3 Returns are only accepted where products are proven to be faulty, unsafe, or incorrectly supplied.
9.4 Returned goods must be unopened, unused, and in original condition unless otherwise agreed in writing.
9.5 Refunds or credits, where approved, may be issued as store credit at our discretion.

11.3 We reserve the right to refuse service to any customer engaging in unreasonable or bad-faith conduct.
